A little taster:

Purpose

To respond to the Motion tabled at the full Council meeting on 22 April 2010 and to answer concerns raised by Councillors during the Council’s Annual Meeting on 21 May 2010 regarding the exercise of delegated decision-making by Cabinet Members.

Recommendation: The Corporate Governance Working Review Group is recommended to advise the Council it –

Affirms its support for the existing delegated decision-making processes subject to the following minor amendments to the process.

1. That the Director of Law and Democratic Services be requested to amend the Briefing Note process, the associated template and the Report Writing Guide and Protocol, to include a requirement for Cabinet Members to consult opposition party group leaders on such categories of Briefing Note decisions as referred to in paragraph 2.13 of this report.

2. The publication in the Members’ Bulletin on a weekly basis of a Notice of any Officer decision made under delegated powers following a Cabinet Member Briefing Note (as set out in Appendix 2).

Recommends that the proposal within the Motion at Council that the Director of Law and Democratic Services be made responsible for the final decision as to how any matter that need formal decision-making by the Council should be made should not be implemented in view of the constraints this might place on Councillors’ ability to have issues discussed in what they consider the appropriate forum.
Reasons

At the Council meeting on 22 April 2010 Councillors Des Moffatt and Kevin Small proposed a motion relating to the exercise of delegated powers and control of the decision-making process.
